WHAT WOULD IT TAKE FOR CBI ENQUIRY TO HAPPEN IN SUSHANT SINGH RAJPUT’S DEATH CASE

As per the ANI reports on Twitter, “#SushantSinghRajput death case: Governor of Bihar accords his consent to Central Bureau of Investigation (CBI) to investigate/ supervise and inquire into the case registered in Patna.”

Nitish Kumar, the Chief Minister of Bihar had previously recommended the handing over of late Bollywood actor Sushant Singh Rajput’s death probe to the CBI (Central Bureau of Investigation) post the consent of Sushant’s family. After the CM’s recommendation, the governor of Bihar has also given his assent to the same and this has come amidst the escalating politics between the two states of Bihar and Maharashtra. Reportedly, the CM of Bihar had suggested, “Since the family has given its consent, we are recommending a CBI probe on the FIR which was lodged in Bihar”. He also added that his government will complete all the formalities and send the recommendation for CBI enquiry on the same day.

As per a notification issued by the Bihar government, “The Governor of Bihar is pleased to accord his consent to exercise of powers and jurisdiction to the whole of Bihar and other places related to the case to the members of Delhi Special Police Establishment to investigate and inquire into the case related to the death of Bollywood actor Sushant Singh Rajput.

So as a large portion of netizens on Twitter claims for a CBI enquiry into the suicide case of Sushant, let’s have a look into the possible requirements to initiate a CBI probe. The consent of both the governments involved in the concerned case is mandatory and as the suicide of Sushant Singh Rajput happened in Mumbai, the investigations have to proceed in Mumbai itself for which the permission from Maharashtra government is necessary along with the approval of Bihar government. Notably, the Chief Minister of Maharashtra, Uddhav Thackeray had ruled out the demand for CBI investigation earlier. However, if the Supreme Court of India orders a CBI probe into the case then no consent from any government will be required to continue the investigation.

Earlier, a minister of Maharashtra told the ANI that in the last 5 years, there have been several incidents of deaths and suicides in Maharashtra which weren’t transferred to the CBI. He claimed that Maharashtra Police was competent enough to handle the case of Sushant’s death and the state government supports the state police.

There have been ongoing political tensions between Maharashtra and Bihar after several allegations against the Mumbai Police that they were trying to cover up the incident under the pressure of influential people. Several people, including the four-member investigating team from Patna Police and BJP leader Narayan Rane of Maharashtra, claimed of a link between the death of Sushant and his former manager Disha Salian and that Sushant could have been murdered. As Sushant’s father filed an FIR under Patna police against Sushant’s girlfriend and actress Rhea Chakraborty and her family members, there has been a difference of opinion of the Patna police and the Mumbai police. So let’s wait and watch if the case is transferred to CBI or not.
